Welcome to The Omniscient Path Inc. These Terms of Service (“Terms”) govern your use of our website and the purchase of our professional coaching sessions, holistic healing services, training or workshops, and digital products. By engaging with our services, you agree to be bound by these Terms, which are designed to protect the integrity of our partnership and ensure compliance with the laws of Ontario, Canada, and the International Coaching Federation (ICF) Code of Ethics.

1. PROFESSIONAL RELATIONSHIP & SCOPE OF SERVICES

The Omniscient Path Inc. provides professional coaching, facilitation, and transformational leadership services and a growing amount of holistic healing services.

  • Coaching vs. Therapy: In accordance with ICF standards, coaching is a partnership for personal and professional evolution. It is not a substitute for professional mental health care, therapy, medical advice, or legal counsel.

  • The Partnership: Our services (including any and all coaching or holistic healing services) are collaborative. Your results depend on your own commitment and the actions you decide to take.

  • Service Delivery: Services may be delivered in person (Live) or via secure digital platforms (Remote).

2. TERMS OF SERVICE & DISCLAIMER REGARDING RECOMMENDATIONS

By engaging with our coaching or holistic healing services, empowerment training, workshops, or any holistic wellness modalities, digital content, or by acting upon any recommendations provided by the Company, you expressly agree to the terms outlined below.

2.1 NATURE OF SERVICES

The Omniscient Path Inc. provides a variety of coaching services i.e. life, career, executive, performance, leadership etc.), career goal and development planning, life transition support. Our philosophy is subtractive; we exist to help you clear external noise and unearth your own inherent wisdom.

Our services—and any discussions, frameworks, or tools used within them—are strictly for informational, educational, and personal development purposes. The Company does not provide medical, psychological, psychiatric, legal, or financial advice.

2.2 EXPLICIT DISCLAIMER REGARDING RECOMMENDATIONS

Throughout the course of our services, the Company, its Founder, Lead Coach, or its affiliated independent practitioners may provide suggestions, referrals, or recommendations. This may include, but is not limited to:

  • Suggested career transitions, professional strategies, or networking introductions.

  • Referrals to third-party professionals, holistic practitioners, or wellness services.

  • Recommendations for books, literature, podcasts, nutritional supplements or educational tools.

  • Suggestions regarding personal habits, routines, or somatic practices.

You acknowledge and agree that all recommendations are offered solely as invitations for exploration and do not constitute professional directives or guarantees of any specific outcome.

If the Company recommends a third-party practitioner, service, or product, we make no representations or warranties regarding the quality, safety, or efficacy of those third parties. Any engagement with a recommended third party is done strictly at your own risk, and you agree that the Company holds no liability for the actions, errors, or omissions of those third parties.

2.3 ASSUMPTION OF RISK AND PERSONAL RESPONSIBILITY

You acknowledge that personal and professional growth involves inherent uncertainties. The decisions you make regarding your career, personal life, health, and wellness based on any recommendations, coaching exercises, or holistic sessions provided by The Omniscient Path Inc. are entirely your own.

You agree that you are fully responsible for your own progress, choices, and results. The Company makes no guarantees, representations, or warranties—express or implied—regarding the success, financial outcomes, or personal breakthroughs you may experience.

3. INVESTMENT & FINANCIAL TERMS

  • Currency: All prices are listed in Canadian Dollars (CAD), unless otherwise specified.

  • Payment: Payments for individual sessions or packages are made via PayPal using Calendly booking or e-transfer to theomniscientpathinc@gmail.com or through the authorized payment processor on The Omniscient Path Inc. website.

  • Package Commitments: Preferred rates offered for multi-session packages (e.g., the Career bundles) are contingent upon the completion of the full package.

4. CANCELLATION & REFUND POLICY (ONTARIO CONSUMER PROTECTION ACT)

Your rights are protected under the Ontario Consumer Protection Act. Our coaching containers are built on commitment and presence. Per the ICF Code of Ethics, our partnership is based on honesty and clear boundaries. I am committed to ethical and fair practices and your complete satisfaction. If you are dissatisfied, please let me know within 24 hours of the session. Refunds for completed sessions are not standard, but I will review any concerns on a case by case basis with fairness and respect for both parties.

  • Cooling-Off Period (Ontario Law): For all coaching agreements signed in Ontario, you have a legal right to cancel the agreement without penalty within 10 days of receiving a written copy of the contract.

  • Scheduling & Cancellations: We require a minimum of 48 hours’ notice for any session rescheduling or cancellation. If a session is cancelled or rescheduled with less than 24 hours' notice, the full session fee will be charged (or one session will be deducted from your prepaid package).

  • Refunds for Completed Work: Completed coaching sessions are non-refundable. The value of our work lies in the exchange of energy and unearthing that occurs during our time together.

  • Termination of Prepaid Packages: If you choose to discontinue a multi-session package, you may request a refund for any unused sessions. Refunds will be calculated using the package discount rate for any unused sessions and will be billed with a 10% administrative processing fee applied to the total remaining balance.

  • Any Omniscient Path refunds provided are to be processed via PayPal or E-transfer per client agreement back to the client within 14 calendar days of cancellation notice.

5. WORKSHOPS AND TRAINING

  • Individual Cancellations: All individual workshop and/or training registrations are fully refundable (minus a $50 administrative fee) up to 14 days prior to the event. Within 14 days prior to the event, registrations are non-refundable but are fully transferable to another seeker or another agreed to event by The Omniscient Path Inc.

  • Group Cancellations: All group and professional workshop and/or training registrations are refundable (minus a $150 administrative fee) up to 30 days prior to the event. Within 30 days prior to the event, registrations are non-refundable but are fully transferable to another agreed event by The Omniscient Path Inc.

  • Cancellations by The Omniscient Path Inc.: If we must cancel a workshop due to unforeseen circumstances, a full refund will be issued. Any Omniscient Path refunds provided are to be processed via PayPal or E-transfer per client agreement back to the client within 14 calendar days of cancellation notice.

6. REMOTE & LIVE PARTICIPATION STANDARDS

  • Virtual Sessions: Clients are responsible for ensuring a stable internet connection and a private, quiet space for remote sessions to maintain the confidentiality of the container. 

  • Live Events: For in-person workshops, attendees must adhere to the venue’s safety guidelines. The Omniscient Path Inc. reserves the right to remove any participant whose conduct disrupts the safety or "sacred space" of the group without a refund.

  • Intellectual Property & Copyright Notice: All materials provided—including Points of You® exercises, digital guides, and proprietary frameworks—are for your personal use, all documents and their contents are the exclusive intellectual property of The Omniscient Path Inc. All rights are strictly reserved. No portion of this material may be reproduced, modified, replicated, or distributed in any form or by any means without express prior written consent. Unauthorized use is strictly prohibited and subject to legal enforcement under the intellectual property laws of the Province of Ontario and the federal laws of Canada.

  • Clients are not permitted to record sessions (either virtual or live events) unless they have prior written consent of The Omniscient Path Inc.

7. PRIVACY & CONFIDENTIALITY

We adhere to the strict confidentiality standards of the ICF Code of Ethics.

  • Privacy: Your personal data is handled in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA).

  • Limits of Confidentiality: Confidentiality is maintained unless there is a legal requirement to disclose information (e.g., risk of imminent harm to self or others) as dictated by the laws of Ontario. 8. LIABILITY & INDEMNIFICATION

  • Disclaimer of Results: While we assist you in becoming the architect of your own evolution, The Omniscient Path Inc. makes no guarantees regarding specific career or financial outcomes.

  • Limitation of Liability: To the maximum extent permitted by Ontario law, our total liability for any claim arising out of our services shall not exceed the total amount paid by you for the service in question.

9. GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws ofCanada applicable therein. Any disputes shall be settled through a "quiet conversation" and good-faith mediation before pursuing legal action in the courts of Ontario.

10. UPDATED TO THESE TERMS

We may update these Terms periodically to reflect changes in our practice or legal requirements. Continued use of our services following any changes constitutes your acceptance of the new Terms.
